Builder’s Remedy Invoked for Housing at 104 Constitution Drive, Menlo Park

Development plans have been filed for a new residential infill at 104 Constitution Drive in Menlo Park, San Mateo County. The project aims to bring over a hundred additional homes to a growing bayside apartment district while replacing several low-slung industrial buildings close to the Meta office campus. Greystar is the project developer.

The 0.87-acre parcel is a surface lot next to recently developed offices and hotels and immediately adjacent to Vasara at 110 Constitution Drive. The latter project is a 335-unit residential apartment complex developed by Greystar, and leasing is now underway. The existing site had been used as a staging area for the construction of Vasara. Previously, 104 Constitution Drive had been approved for a 35,000-square-foot office and commercial building as part of the Vasara master plan.

The proposal aims to be eight floors tall with a rooftop height of 92 feet. The complex will have 140 apartments spread across roughly 151,000 square feet. The application invokes the Builder’s Remedy to protect and streamline the approval process. California cities without state-approved housing elements are subject to the Builder’s Remedy, which allows developers to file plans with at least 20% affordable housing to sidestep zoning restrictions.

The formal application was filed in early June, with the city review concluding last week. The estimated cost and timeline for final approval and construction have yet to ben established.

Greystar has yet to reply to a request for additional information about plans for 104 Constitution Drive.

  1. Good. Long, long overdue. Easy access to both 101 and Dumbarton, for the 35% of tech workers who still have to commute to offices 5 days a week.
