New plans have been filed for a suburban expansion at 19780 Almaden Road in San Jose, Santa Clara County. The application uses the Builder’s Remedy to streamline approval and increase residential capacity to 41 homes. Michael Labarbera of Terracommercial Real Estate is listed as project developer.
The property is located along the southern edge of San Jose. Construction will span 18.62 acres, averaging just around 2.2 units per acre. While Of the 41 homes, eight will be deed-restricted as affordable to low-income households.
Residents will be on the edge of a suburban neighborhood bordering Alamitos Creek and near the historic New Almaden mining town. The estimated timeline for construction is not included.
The Builder’s Remedy is a recently-activated state code provision, though it was passed in 1990. The law grabbed headlines earlier this year during a state review period for city housing elements. Cities with non-compliant housing elements are now subject to the Builder’s Remedy, and with a renewed focus on the rule, developers are starting to use it.
The first Builder’s Remedy plan for the Bay Area was for an apartment in Los Altos Hills, with more filings across the Peninsula. The largest so far is a 30-story tower planned for 80 Willow Road in Menlo Park, bordering Palo Alto.

This seems like a terrible idea, expanding suburban sprawl with giant houses and lots. Nothing is walkable from this location. Biking is super risky with no infrastructure. Car dependant sprawl does not help anyone.
